Privacy Policy (Datenschutzerklärung)

1. Controller

2. Overview of data processing

We process personal data only when necessary to operate this website and fulfil orders. We do not sell personal data to third parties. Data is processed on the legal bases set out below (Art. 6 GDPR).

3. Hosting — Vercel

This website is hosted by Vercel Inc., 440 N Baxter St, Los Angeles, CA 90026, USA. When you visit our site, Vercel processes your IP address, browser type, operating system, referrer URL, and the date/time of access in server log files. This is necessary to deliver the website (Art. 6(1)(f) GDPR — legitimate interest in a secure and efficient web presence). Vercel may transfer data to servers in the United States. Data transfer to the US is covered by Vercel's Data Processing Addendum and the EU–US Data Privacy Framework. More information: vercel.com/legal/privacy-policy.

4. Web Analytics — Vercel Analytics & Speed Insights

We use Vercel Web Analytics and Vercel Speed Insights to understand how visitors use our site and to monitor performance. These tools collect anonymised, aggregated usage data (e.g. page views, load times). Vercel Analytics is privacy-focused and does not use cookies or track individual visitors across sites. 5. Payment processing — Stripe

Payments are processed by Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Dublin 2, Ireland (and its US parent Stripe, Inc.). When you make a purchase, Stripe receives your payment card details, name, email, billing address, and IP address. We never see or store your full card number. Stripe processes this data as an independent controller to fulfil the payment transaction and to comply with legal obligations (e.g. anti-fraud, anti-money-laundering). Legal basis: Art. 6(1)(b) GDPR (performance of a contract) and Art. 6(1)(f) GDPR (fraud prevention). Stripe may transfer data to the USA under the EU–US Data Privacy Framework. 6. Content management — Sanity

We use Sanity AS, Grensen 13, 0159 Oslo, Norway, as our content management system. Painting images and descriptions are delivered from Sanity's CDN. When you load a page, your browser may connect to Sanity's servers and transmit your IP address to retrieve content. Legal basis: Art. 6(1)(f) GDPR (legitimate interest in efficient content delivery). Sanity's CDN may route through servers outside the EEA; transfers are safeguarded by standard contractual clauses. 7. Order emails

When you place an order we use your email address to send order confirmations and shipping updates. If you opted in, we may also send occasional updates about new work. Legal basis: Art. 6(1)(b) GDPR (contract) and Art. 6(1)(a) GDPR (consent for marketing). You can unsubscribe from marketing emails at any time by clicking "unsubscribe" or contacting us.

8. SSL / TLS encryption

This site uses SSL/TLS encryption (recognisable by "https://") for security reasons and to protect the transmission of personal data and other confidential content.

9. Cookies

This website does not set its own cookies for tracking or advertising purposes. Technically necessary cookies may be set by Stripe during the checkout process to enable payment functionality. Vercel Analytics operates without cookies.

10. Data retention

Order data (name, address, email, purchase details) is retained for the duration of the statutory retention period required by German commercial and tax law (§ 147 AO, § 257 HGB) — generally 6 to 10 years. After expiry, data is deleted unless further retention is required by law or necessary for the establishment, exercise, or defence of legal claims.

11. Your rights

Under the GDPR, you have the right to:

  • Access (Art. 15) — obtain confirmation of whether and which personal data we process.
  • Rectification (Art. 16) — request correction of inaccurate data.
  • Erasure (Art. 17) — request deletion of your data ("right to be forgotten"), subject to legal retention obligations.
  • Restriction of processing (Art. 18) — request that processing be restricted under certain conditions.
  • Data portability (Art. 20) — receive your data in a structured, commonly used, machine-readable format.
  • Objection (Art. 21) — object to processing based on legitimate interests at any time, for reasons arising from your particular situation.
  • Withdrawal of consent (Art. 7(3)) — withdraw any consent given at any time, without affecting the lawfulness of processing before withdrawal.

12. Right to lodge a complaint

Terms of Sale (AGB)

These terms apply to all orders placed through yutori-art.de. The contract language is English. By placing an order you agree to these terms.

Scope & contract formation

The presentation of paintings on this website constitutes a non-binding invitation to make an offer (invitatio ad offerendum). By completing the checkout you submit a binding purchase offer. The contract is formed when you receive our order confirmation email or when Stripe confirms the payment, whichever comes first.

Prices & payment

All prices are in EUR and include any applicable taxes. As a small business under § 19 UStG, no VAT is charged. Payment is processed securely via Stripe. We accept major credit and debit cards. The purchase price is charged at the time of order.

Ownership & risk

Each painting is a unique original work. Title passes to you upon full payment. Risk of loss or damage passes to the shipping carrier upon handover (for consumers within Germany: upon delivery to you, § 447 BGB in conjunction with § 475 Abs. 2 BGB).

Availability

Because every painting is one-of-a-kind, availability cannot be guaranteed. We reserve the right to refuse or cancel orders in case of pricing errors, fraud suspicion, or if a painting is no longer available.

Applicable law & jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers within the EU, mandatory consumer-protection provisions of your country of residence remain unaffected. Place of jurisdiction for merchants is Neuss, Germany.

Right of Withdrawal (Widerrufsbelehrung)

Withdrawal policy for consumers in the EU / EEA

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you, or a third party other than the carrier indicated by you, acquires physical possession of the goods.

To exercise the right of withdrawal, you must inform us of your decision to withdraw by an unequivocal statement (e.g. an email) sent to:

Effects of withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including the cost of delivery (except supplementary costs arising if you chose a type of delivery other than the least expensive standard delivery offered), without undue delay and in any event not later than 14 days from the day on which we are informed of your decision to withdraw. We will use the same means of payment as you used for the initial transaction; in any event, you will not incur any fees as a result of the reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You shall send back the goods without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal. The direct cost of returning the goods is borne by you. You are liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Exceptions

The right of withdrawal does not apply to contracts for the supply of goods that are made to the consumer's specifications or are clearly personalised (§ 312g Abs. 2 Nr. 1 BGB). If you commission a custom or made-to-order painting, you will be informed before purchase that the right of withdrawal is excluded.

Shipping & Returns

Paintings are shipped unframed, rolled in an archival tube with acid-free tissue, insured. Delivery is typically 5–7 business days (Germany and EU) and may be longer for international orders. Shipping costs are shown at checkout.

If your painting arrives damaged in transit, contact us at studio@yutori-art.de with your order number and photos within 14 days of delivery. We will arrange a replacement or full refund.

Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr.

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
